The case of Simon van Houten, 31, is a cautionary tale of a rogue managing agent making free with leasehold owners’ funds.

Van Houten, 31, was given a 30-month prison sentence at the Old Bailey in July 2012 after pleading guilty to stealing £122,000 from leasehold service charge accounts held by London managing agent Rendall and Rittner.

Van Houten carried out the fraud for two years between 2008 and 2010 by issuing invoices for a bogus maintenance company, “London Decorating Services”, which he subsequently approved and paid.

The ruling Conservative party was kicking back at brokers and freeholders over insurance kickbacks and commissions as early as 2006, Leasehold Knowledge Partnership can reveal, with RICS and FCA predecessor, the FSA, agreeing there was a problem.

Ex cabinet ministers Gregory Barker, then shadow environment minister, and Theresa Villiers, then shadow chief secretary to the Treasury, joined forces in Parliament to bombard government ministers and officials throughout 2006 with pointed questions motivated by concerns that ordinary homeowners were paying sizeable commissions – blended into their buildings insurance premiums by way of landlord-controlled service charges – under the controversial leasehold system.

Rendall & Rittner makes nearly £1 million a year in gas and electricity commissions

With energy prices sky-rocketing, Rendall & Rittner leaseholders will be concerned to learn that their managing agent receives £969,000 a year in commission on communal gas and electricity supplies.

According to a letter posted on Rendall & Rittner’s blog, the commissions are paid at the rate of 0.03 pence per unit (kilowatt hour) of electricity. Gas attracts a lower commission of 0.015 pence per unit.

According to the letter, Rendall & Rittner estimates it buys of 182 gigawatts of electricity and 282 gigawatts of gas each year.

Leaseholders win control of 1,132-flat Chelsea Bridge Wharf … which means they also manage the HQ of housebuilder the Berkeley Group

Leaseholders have won the right to manage of the landmark Thames riverside site Chelsea Bridge Wharf, which includes the headquarters of the developer that built it, the Berkeley Group.

This is a hugely significant achievement, bringing flat-owner empowerment to one of the most important leasehold sites in the country just at the point when government is bringing forward a succession of reforms.

The victory is a loud rebuke to the existing system whereby management is imposed on flat owners by freeholders or head lessees, whose financial stake is a mere fraction of the value of the building.
